Conveyancers get an unfair reputation, they – fee earners in particular – are often blamed whenever something goes wrong during the conveyancing process. When often the fault doesn’t lie with the fee earner, and they are blamed for things that are outside their control, e.g. councils only process searches in bulk so the fee earner must wait for another 100 searches to be submitted before they get their results back.  

A recent article in Property Industry Eye led with the headline ‘Conveyancers blamed for property transaction delays’ but that wasn’t what the article concluded. The primary conclusion of the article was the sheer volume of cases was at the heart of the issue with poor communication and a lack of consistency from Local Authorities playing their part. Yet somehow the conveyancers are publicly blamed for an issue not just of their making. Misleading headlines like this only drive a wedge further between parties who need to be communicating better, not worse. 

Conveyancers get a bad reputation because they are easy targets. They’re responsible for ensuring the legal side of the transaction and are available to contact, while not being able to control a couple of the key aspects of the process, for example the response times of Local Authorities.  

Without substantive changes to the Law, the best two things that can be done to speed up the average transaction time are increased communication by every party involved in the transaction and getting consumers involved in the conveyancing process as soon as they bring the property to market.
